1. Introduction

Welcome to the Fibbers York Archive. This website is a community-driven historical archive dedicated to documenting, preserving, and celebrating thirty years of live music presented by Fibbers in York, UK and Mr H (Tim Hornsby) (1992–2022). By accessing the website, creating an account, sharing memories, claiming band memberships, or purchasing archival merchandise, you agree to these terms. This site is operated in the United Kingdom and is governed by English law.

2. User-Generated Content & Community Guidelines

The archive thrives on the stories, memories, gig ticket scans, and photographs contributed by musicians and fans. When participating in the archive, you agree to adhere to the following community standards:

  • Authenticity & Copyright: You warrant that any text, stories, or photos you post are your own original content, or that you have full permission from the copyright owner to share them publicly in the archive.
  • Respectful Conduct: You must not post content that is defamatory, abusive, offensive, harassing, obscene, hateful, discriminatory, or unlawful.
  • Relevance: Contributions should remain relevant to the history, artists, gigs, staff, and culture of Fibbers York. Spam, commercial advertising, or unrelated self-promotion is strictly prohibited.

3. Content Moderation, Notice & Takedown Policy

We operate on a Notice and Takedown basis. Due to the historical and collaborative nature of the archive, user contributions are published directly by registered contributors and are not continuously pre-moderated before appearing on the site.

Our Commitment to Prompt Removal

If you are a copyright owner, musician, venue attendee, or third party and believe that any comment, memory, photograph, or material on this site is defamatory, inaccurate, infringes your copyright or privacy, or is otherwise inappropriate, please let us know immediately.

You can flag comments directly using the on-page Report button, or contact us through our website. Upon receiving a substantiated notice, we will investigate and expeditiously remove or disable access to the contested material.

We reserve the right to edit, unpublish, or delete any comment, photograph, band link, or attendee record, and to suspend, deactivate, or ban user accounts at our sole discretion, without liability and without prior notice.

4. License to Archive Your Contributions

You retain copyright in your original words, photographs, and memories. However, by posting them to the Fibbers York Archive, you grant us a perpetual, irrevocable, royalty-free, worldwide, non-exclusive license to display, store, index, format, and showcase your contributions across the website and associated archival publications.

This license allows the archive to preserve your gig memories for future generations as a permanent historical record.

5. Band Memberships & Gig Attendance Claims

Features such as "I was in this band" and "I was at this gig" are crowd-sourced community records submitted in good faith. Band member claims require administrative verification before displaying as "Verified Member". We reserve the right to approve, reject, or revoke membership badges and attendance marks to preserve the historical accuracy of the venue's records.

6. Archival Merchandise & Orders

We offer custom-printed memorabilia (such as mugs and apparel) featuring archival flyers and historic venue imagery.

  • All orders are subject to availability, acceptance, and payment verification via our secure payment provider (Stripe).
  • While we make every effort to display colours and print positioning accurately, slight variations may occur between the on-screen digital preview and the final physical print.
  • Purchasing a keepsake gives you a physical item for personal enjoyment. It does not transfer any copyright, trademark, or commercial licensing rights in the underlying logos or flyer artwork.

7. Returns, Refunds & Consumer Rights

Under UK consumer protection regulations, your statutory rights are respected:

  • Faulty or Damaged Items: If your order arrives damaged, defective, or with printing errors, please notify us within 14 days of delivery with photographic evidence. We will arrange a prompt replacement or full refund.
  • Custom-Printed Goods: Because items are individually printed on demand upon order, we cannot accept returns or refunds for change of mind or ordering incorrect garment sizes. Please verify sizing charts before ordering.

8. Limitation of Liability

The Fibbers York Archive is provided on an "as is" and "as available" basis. While we strive to ensure dates, setlists, lineups, and flyers are accurate, we make no guarantees regarding completeness or accuracy. To the maximum extent permitted by UK law, the archive operators, contributors, and venue alumni are not liable for any indirect, incidental, or consequential losses arising from website use or purchased goods.
